EB-2 NIW Eligibility: Do You Qualify?

EB-2 NIW eligibility is a two-part question: do you meet the EB-2 category, and does your specific proposed endeavor satisfy the three-prong Dhanasar standard? Strong credentials are necessary but not sufficient. Many people with impressive records still need to do substantial work on how they frame their endeavor and structure their evidence package.

  • EB-2 category: advanced degree (master's or above), OR exceptional ability, OR bachelor's plus five years of progressive experience
  • Your proposed endeavor must have substantial merit and national importance — going beyond your employer or locality
  • You must be well-positioned to advance the endeavor: track record plus a credible forward plan
  • It must be in the U.S. interest to waive the job-offer and labor-certification requirements for your case

No. The NIW lets you self-petition without a U.S. employer. Whether you're inside or outside the U.S. affects whether you adjust status here or go through consular processing abroad — not whether you can file.

Can I qualify if my work mainly benefits my employer?

Impact limited to a single employer is generally weaker under Prong 1. The petition is stronger when your endeavor's benefits extend to the broader field, public, or economy.

Can a Ph.D. student apply?
